Prosecutors Say No Deal; Police Say Hydrocodone Not In System

POSTED: 2:02 pm CST February 17, 2006
UPDATED: 6:55 pm CST February 17, 2006

Payne County District Attorney Rob Hudson said there is no deal in place regarding a driving under the influence charge filed today against Oklahoma State basketball coach Eddie Sutton.

An affidavit filed with the charges said Sutton's blood-alcohol level was .22 percent -- nearly three times the legal limit of .08. However, investigators said during a Friday news conference that the blood test indicated that there was no hydrocodone in the coach's system.

During a news conference on Wednesday night, Sutton said he had taken pain pills and drank alcohol last week before a car accident in Stillwater. According to what the investigator divulged on Friday, the report indicated that pain pills were not in Sutton's system -- just alcohol.

Hudson today filed a misdemeanor charge of aggravated DUI in an accident with injury in connection with last Friday's accident that left Sutton and a woman injured. Additional charges of speeding and driving left of center were also filed.

Hudson said there is no warrant for Sutton's arrest and he'll be allowed to voluntarily appear when he's released from treatment.

Sutton has said he will re-enter an alcohol treatment program and has taken a medical leave of absence.

Hudson said he's also spoken with the woman who was injured in the accident and says she wants Sutton to not only be held accountable, but also to get treatment.
